Terms and conditions of use

• "miqpo", "we", "our": refers to Miqpo SAS, a company registered in Colombia (NIT pending registration).
• "Platform": the miqpo.com website, the mobile app and all related services.
• "User", "you": any person who accesses or uses the Platform.
• "Driver": a user who publishes a trip in their private vehicle.
• "Passenger": a user who books a seat on a published trip.
• "Trip": a route in a private vehicle between an origin and a destination, published by a driver.
• "Carpooling": the practice of sharing the costs of a trip between driver and passengers. It is not a commercial transport service.
• "Community": a closed group of verified users from the same institution (university, company, etc.).

2.1 Connection platform

miqpo is a technology platform that connects users to share trips. We are not:

• A commercial transport service (like ride-hailing apps or taxis)
• A taxi or VTC company
• Vehicle owners
• Employers of drivers
• Responsible for the trips that take place

2.2 Carpooling vs. commercial transport

Trips on miqpo are carpooling (sharing costs), not commercial transport. Key differences:

3.1 Registration requirements

To use miqpo, you must:

• Be over 18 years old
• Provide truthful and up-to-date information
• Create an account with a valid email
• Accept these Terms and the Privacy Policy

3.2 Institutional verification

To access community trips or publish trips, you must verify your institutional email with an OTP code. By verifying, you confirm that:

• You are an active student or employee of the institution
• You have a legitimate right to use that email
• You use your institutional email under your own responsibility and in accordance with your institution's policies

3.3 Account security

You are responsible for keeping your password confidential. Any activity on your account is considered to have been carried out by you. Notify us immediately if you detect unauthorized access.

4.1 Prohibited conduct

Users may not:

• Publish false or fraudulent trips
• Use the platform for commercial transport or profit
• Harass, discriminate against or threaten other users
• Publish illegal, offensive or inappropriate content
• Attempt to hack, scrape or damage the platform
• Use multiple accounts to evade restrictions
• Charge excessive prices (more than 20% over the real costs)
• Offer or request services off the platform to evade community rules

4.2 For drivers

By publishing a trip, the driver confirms that:

• The trip was already planned (not created just to make money)
• They hold a valid and appropriate driver's license
• The vehicle has valid SOAT or insurance and an up-to-date technical-mechanical inspection
• The vehicle is in safe operating condition
• The published price reflects only real costs (fuel, tolls, wear)
• They will honor confirmed bookings (not canceling without a valid reason)

4.3 For passengers

By booking a trip, the passenger confirms that:

• They will pay the agreed amount to the driver
• They will arrive on time at the meeting point
• They will respect the driver's rules (for example, no smoking)
• They will behave respectfully during the trip
• They will not cancel without reasonable advance notice (minimum 3 hours)

5.1 Use of the platform

During the launch phase, using miqpo is free:

• Publishing and booking trips is free of charge.
• miqpo does not charge a commission on trips or take any part of the money users share.

If a charge for using the platform is introduced in the future, it will be communicated clearly and in advance. Any charge would correspond to the technology service, not to the transport.

5.2 Passenger - driver payment

Payment from passenger to driver happens off the platform (cash, direct transfer). miqpo does not process payments between users.

The agreed amount must cover only the trip costs:

• Fuel (proportional share)
• Tolls (proportional share)
• Vehicle wear (reasonable estimate)

5.3 Payment disputes

miqpo is not responsible for payment disputes between users. If there's a disagreement:

1. Users should try to resolve it directly
2. If there's no agreement, they can report it to soporte@miqpo.com
3. miqpo may mediate, but will not refund or compensate
4. Users with multiple disputes may be suspended

6.1 miqpo is not responsible for:

• Traffic accidents during the trips
• Personal injury or property damage
• Loss or theft of belongings
• The behavior of drivers or passengers
• The accuracy of the information published by users
• The quality, safety or legality of the vehicles
• Cancellations, delays or changes of plans
• Disputes between users

6.2 Users are responsible for:

• Their own safety during the trips
• Verifying identity and profiles before traveling
• Complying with traffic and transport laws
• Keeping their insurance valid (SOAT/vehicle)
• Resolving disputes in good faith

miqpo and all its content (logo, design, code, text, images) are the exclusive property of Miqpo SAS or its licensors. Users may not:

• Copy, modify or redistribute the content
• Use the "miqpo" brand for commercial purposes
• Create derivative or competing platforms
• Reverse-engineer the code

Users retain the rights to the content they publish (profile photos, comments), but grant miqpo a license to use it in operating the platform.
